枫下茶话 / 美国话题 / US immigration visa was approved,for tax purposes, is it better to wait and activate the visa after the new year i.e.in 2012, or it doesn't make much difference?

As far as I know, if you live in the States less than 183 days in 2011, you can choose to file your tax as nonresident or as resident if you activate your immigration visa. This is called "dual status".As a nonresident, you claim a smaller standard deduction than that as a resident. The difference is largely determined by your income level, not your legal status there.

thank you for your reply. Officially I will be on vacation from my current work (Canadian company)when I cross the border on 23 Dec. My US income for 2011 will be zero. Hopefully I don't need to file a tax return on the US side for 2011.
