He may file as married filed seperately then he does not have to include your Canadian income. Or he can married file jointly but he must report his family income to the US.

先生去年在加工作只一个半月,其它时间持TN在美工作.我和孩子都在加.先生在美国报税应该是按non-resident吧? 另外能否按家庭报税,这样可以有一些给家属的tax credit,否则好象是按individual报,要交很多税啊.是否我可以申请一个报税NUMBER?

可以按US non resident报,这样他去美国之前的加拿大收入就不用报,你们最终还是要给加拿大报美国的收入的,加拿大税率比美国要高,所以按美国resident 或者non resident 应该差别不大

我的情况类似。我觉得如果可以应该尽量以resident报税,这样美国的税会少交点。加拿大虽然还是要报税,但是可以通过买rrsp来0避免在加拿大补税。

加拿大有没有类似美国的TRADITIONAL IRA,即可以在报税前权衡自己的报税额,再决定是否需要买.谢谢KWIRKY,你已经回答了我很多问题了.

有,RRSP。但和IRA不同,它有点类似于401(K),有18%的限制/19K,whichever is less.

IRA是类似加拿大的RRSP, ROTHIRA是指用税后的钱投资,但是赚得部分不用交税,每年有额度,不知道今年多少,以前一年最多存4000元。

今年的IRA还是4000,但要看你的收入,如果收入高的话,多存是无利于退税.如果存Traditional IRA,当前就可以退税.如Roth IRA就是赚的部分不用交税.

夫妻一人在美国,一人在加拿大,关于是否夫妻合报还是分开报的问题,感觉好像合报可以省很多。不知论坛上有人这样做吗? 是不是太麻烦了?大家可以讨论一下。

夫妻合报(均以resident alien身份),一方在加拿大的收入也要计算在内,但是如果这一方在国外(加拿大)一年居住超过330天,则可以waive大概8万不用报税,这样实际上是只交另一方在美国的收入的税?好像可以省好几千的税?我是不是miss掉什么了?

publication 519, page 15, chapter 3, Resident Alien section: If you are physically present in a foreign country or countries for at least 330 full days during any period of 12 consecutive months, you may qualify for the foreign earned income exclusion.The exclusion is $85,700 in 2007.

the problem is..IRA can consider the guy, who works 330 days/year in Canada, as a USA resident alien ? I doubt it.

It's mentioned in Pub 519, page 10, "Nonresident spouse treated as a resident" section.
The idea is that you can choose to treate non resident spouse of resident alien as a U.S. resident, thus the couple can file jointly as resident.

See tax home on page 12 of pub 54. If you tax home is in the US, you can not exclude your Canadian income.
