枫下茶话 / 美国话题 / 'Married Filing Jointly', 'Married Filing Separately' and 'Head of a House-hold', which one shall I use?I have TN visa. My spouse and son have TD visas and living with me. Shall I file tax using 'Married Filing Jointly', 'Married Filing Separately' or 'Head of a House-hold'? In 'Married Filing Jointly', it says that 'a husband and wife cannot file a joint return if either spuse is a nonresident alient at any time during the year.' Is that means we are not eligible for 'Married Filing Jointly'? Thanks!

I think should be "Married file jointly."

if you file 1040NR, you can't file jointly. Only if you file 1040 or 1040EZ can you file jointly.
