枫下茶话 / 美国话题 / I'm canadian citizen, holding J1 visa as a trainee in a US university. I file a tax return as a non-resident alien in US and qualify for exemption under Article XV per our university human resource.Article XV said : wages and other similar remuneration derived by a resident of a Contracting State in respect of an employment shall be taxable only in that State. But I phoned CRA that I need pay the gap of tax, no tax-free in canada. I am really confused. Please clarify. Thanks in advance!

Thanks for your comments. But the article XV said " taxable only in that state"--only in USA. IF I pay tax in canada, that's double tax.

The point is: which country are you claiming your residence? You cannot claim both non-residence status in US and Canada. If you file 1040NR, you are non-resident of US, then you're resident of Canada and need to file part-year T1 in Canada.
