枫下茶话 / 法律 / 公司给我的合同这部分合法吗?As an employee, you acknowledge that the company has the right to change the reporting relationships, job location, duties and responsibilities unilaterally, with notice as the company deems appropriate.
这岂不是随便让公司玩了吗?
公司如果让我去扫厕所,我不去,公司就有权利fire我,还不用给任何补偿。
这项合法吗?

Yes, but not all the policies are reasonable, some are too restrictive, some have confliction with the law.For example, today I recieve a letter from HR. says that all vacation will be fortei( wrong spelling, means disppear消失, 剥夺),if anyone dont take vacation in the end of fiscal year. that's one.
And another one is, I college said, the company can't force us to take vacation, can't put it in writing. if it is put in wrinting, sometimes trouble will come.
As I know, some middle/small company do make some policy which is un-reasonable and "stupid".

存在就是合理:休假不能carry是正常的,无论公司大小。俺猫的公司原来可以carry,结果很多员工存了半年以上的假。一旦休起来严重影响工作开展。现在只能最多carry多少强迫员工放假。而且从法律上讲,一年两个星期的假是一定要放的。即使是contractor也是这样。否则政府会认为公司剥削员工。这可是劳动法的规定。虽然查得不严,但没有放假的员工如果控告公司,公司是说不清的。所以还有公司强制员工放假,可能就是被告过。

我的公司合同说,你在公司期间的一切发明创造都是公司的财产。算了,不计较了,先干上几年再说。新移民先要奉献,然后索取。

你可以想象,如果不是这么规定,那事后岂不是可以控告公司侵犯你的知识产权?而且公司在保护自己的知识产权的时候也必须有法律文件证明知识产权是属于自己的。

doesn't matter, when the title changed, it is treat as termination of the previous employement contract(which indicate the certain job title/location).if no new contract is signed, they are the side termitate the contract on ROE. u get EI.
