I am planning to take one year maternity leave in 2006 full year, I will hire a baby sister for half year, somebody told me that I had already get the benefit from maternity leave and I don't work and pay little tax, so even my husband work in 2006, we still not qualify to claim for child care becuase it only gives to the person who works. I am not sure if they are right, any advice?

No. According to tax guide,the lower earned income (maternity leave pay is not considered as earned income, sample earned income: work, self-employment income and etc.)person in the family has to claim the Child care expense. If you maternity leave for 10 months, and two months work, you can claim maximum child care expense as 2/3 of your income for that two months.

For 2006 y, I will only work for half month, then I will go to maternity leave untill the end of year, does that means I cannot claim for any child day care tax benefits in my return?Thanks

2/3 of your work income, that's the maximum child care expense you can claim.
