枫下茶话 / 法律 / 请问,我是美国的H1,我收到移民局的信件:need me appear on the Hearing With a Citizenship Judge. 主要是他们认为我居住时间不够。(我在BUFFALO工作而住在加拿大的Nigara Falls,基本每天来回)我是不是需要找律师呢?谢谢!如题。

你这种情况是完全符合在加拿大居住的要求的,CIC明文规定去美国当日往返的不算离境。你要做的是收集证据证明你的确每日当天往返,你每天回加拿大一侧总有过关的证件吧?你在加拿大当地总有银行账户,保险,汽车登记和驾照吧?等等有什么带上什么,不认为你有必要请律师,律师也未必能跟你一起出席hearing

谢谢!但是我的Case中有一个情况,当时过关时,我告诉他们我主要住在USA,现在临时住在Canada....2004年前7个月住在buffalo,而后5个月住在Canada,我的车keep美国的车牌。当时我告诉加拿大海关的移民部门工作人员在2004年度我大部分时间住在美国,而现在我是住在加拿大。
为什么我要保持美国的车牌呢?第一,在2004年度我主要住在美国。第二,美国的汽车保险比加拿大便宜许多。
每天往返实在麻烦,而我在住完比规定时间(4年中有3年住在加拿大)多一个月时,我就搬回美国住了。
这种情况不知道怎么和Judge说清楚,实在是心中没底。

我记得我同事打电话问过, 说是哪怕离境一个小时也算是离境一天, 在报公民时候要报出来,公民申请表也有类似的说明,不过没那么详细. 所以我把当天往返的全报了,并且扣除了. 是不是当天往返只是可以保持居住权利,而不是申请公民的权利呢? 这两项有时候要求不同的.
