枫下茶话 / 美国话题 / In 2004, I worked in Canada until Sep and came to US via TN. Now I have a question about Tax. Since I lived in Canada more than 183 days, I can't claim non-resident status. How should I file Tax form?

I don't know if you can claim NON-resident. The definition in Canada Revenue Agency
is not very clear. Any idea? You're a non-resident for tax purposes if you:
* normally, customarily, or routinely live in another country and aren't considered a resident of Canada; or
* don't have residential ties in Canada; and
o you live outside Canada throughout the tax year; or
o you stay in Canada for less than 183 days in the tax year.

yes,you can claim as non-residence. I just gave the tax office a call. Got it very clear that since you left the country and severed all canadian ties, you are a non-residence after the time you left, no matter when you left in the year.
