2 Consultant agrees that, in exchange for the opportunity to provide Contractor with qualified computer programming services, Consultant will not solicit, attempt to solicit, inquire about, contact or attempt to place himself/herself or other consultants, directly or indirectly, through any contacts made pursuant to this agreement; a) with any client company of Contractor, at a site or on a project for which Consultant is introduced by Contractor, or b) with any client company of Contractor about whom Consultant becomes aware solely through its relationship with Contractor, for a period of 90 days following the execution of this Agreement.
3 Consultant agrees that, if he/she is confirmed/selected within 48 hours after the final interview, he/she will accept the assignment for which International Systems Technologies Inc. has represented. Within this 48-hour period, Consultant must inform International Systems Technologies Inc., prior to being confirmed/selected, that the Consultant wishes to withdraw from consideration, for any reason whatsoever, for the assignment for which International Systems Technologies Inc. has represented.
4 In the case of breach of the above covenants 2 or 3, within a period of 90 days following the execution of this agreement, Contractor will seek injunctive relief in the courts of New Jersey. It is very difficult if not impossible to determine exact amount of damages for breach of this agreement. The consultant agrees to pay the court and legal fees in addition to the monetary damages as determined by the Courts of New Jersey.
