TN/TD/H1B/H4 Questions

My wife and I are both TN holder now. Both companies are going to apply H1B for us this year. However, my company may have a big wave of layoff within 90 days. So I have two choices before Oct. 1, 2008. One is to get a TD before Oct. 1, 2008 then change status to H4. Or I am lucky enough to get an offer back to TN. So my questions are:

1. Can I get a new TN if my H1B application is approved?
2. Can I change my status from H4 to TN?
3. Can I change H1B to TN if the next company doesn't want having transfering H1B?

    • Do u want to apply green card using H1B? If u r in the process of green card, probably u'll have trouble to transfer from H1B to TN. -sapple(似水流年); 2008-3-21 (#4346104@0)
      • You can transfer to TN before you submit 485. If the company submit 140 for you, some of the border police officer to give you a hard time. Mail transfer might be a good chioce. -kwirky(kwirky); 2008-3-21 (#4346156@0)
