Plan 1. B1/B2 (Job hunt) -> H-1B -> PERM (LC) -> I-140 + I-485 -> Priority Date -> EAD + AP -> GC

Plan 2. B1/B2 (Job hunt) -> H-1B -> PERM (LC) -> I-140 -> Priority Date -> CP -> GC

Not recommended because if CP failed, one will have to get out from US.

For Canadian Citizen:

Plan 3. TN -> PERM (LC) -> I-140 -> Priority Date -> I-485 + EAD + AP -> GC

Not Ok for Chinese because Priority Date will take very long time and since got I-140, it is hard to renew the TN.

Plan 4. TN -> PERM (LC) -> I-140 -> Priority Date -> CP -> GC

Not Ok for Chinese because Priority Date will take very long time and since got I-140, it is hard to renew the TN. Not recommended because if CP failed, one will have to get out from US.

Plan 5. TN -> PERM (LC) -> H-1B -> I-140 + I-485 -> Priority Date -> EAD + AP -> GC

Ok.

Plan 6. TN -> H-1B -> PERM (LC) -> I-140 + I-485 -> Priority Date -> EAD + AP -> GC

Not necessary apply for LC after H-1B. It will waste some times. Prefer to Plan 5.

Best option for Canadian PR, Plan 1.

    I am working in Detroit with TN visa. If I want my company to sponsor the H1B and GC for me, should I have to keep staying in US or I can move back to windsor and commute everyday during the long waiting period? Thanks for the help.

      • For those Canadian born in China, H1B is the first step to get the GC .
        You have to renew TN every year. H1B is not that hard to get as long as your company sponsors you.

    • The answer is Yes and No, as it takes time for H1B to be approved, around 4+ month. During this period, you MAY not travel internationally. But if you travel internationally, seems there're some concequences afterwards which I am not too sure.
      • Thanks. Actually, compared the the total time required to get GC, waiting period for the H1B is nothing.
        My only concern here is whether living in Windsor during the period of GC applciation could adversely affect the results. Anyone has ideas or experience? Please share. Thanks

            Just kidding. Actually, Detroit is not that bad, especially for those suburb areas. I have to move back, purely because of the family issues. Any ideas about the potential consequences?
            • I could not see the adverse consequence apart from that you will have too stay is US before you get H-1B. However, you will be benefited during I-485 + EAD period. Nevertheless, if you wish we can discuss this further.

              Way A:
              1. NT
              2. PERM (permanent labor certification)
              3. I-140 (to change status to become PR) (Do not file I-845 concurrently)
              4. Priority date becomes current for I-140 (Renew NT through mail to avoid wrongful deny from low level staff)
              5. I-485 + EAD (Employment Authorization Document) + AP (Advance Parole)
              6. Green Card

              Way B:
              1. NT

              The key difference are: NT supposes could not have intent to stay permanently, but H-1B is dual intent visa/stutas. If you go Way A, you won't be able to renew your NT. The consequence is you might get some trouble to travel back to US during I-485 + EAD period, if you have ever left US. If you go Way B, you won't be able to leave US during H-1B application period.

                If my company submits the H1B application for me at April 1, I have to keep staying in US till Oct after I get my H1B??? Never heard it before. Can anyone confirm it for me?? Thanks

              • 由于中国出生的人办绿卡时间太长(5-6年),在这期间renew TN风险太大,要冒4-5次险。不但是移民申请的问题,还有TN本来算是临时工作签证。Plan B,TN->H1->Perm,在申请H1其间,可以离开美国。
