本文发表在 rolia.net 枫下论坛As I know, in general there are two ways to get GC:
Way A:
1. NT
2. PERM (permanent labor certification)
3. I-140 (to change status to become PR) (Do not file I-845 concurrently)
4. Priority date becomes current for I-140 (Renew NT through mail to avoid wrongful deny from low level staff)
5. I-485 + EAD (Employment Authorization Document) + AP (Advance Parole)
6. Green Card
Way B:
1. NT
2. PERM (permanent labor certification)
3. H-1B
4. I-140 (to change status to become PR) (Do not file I-845 concurrently)
5. Priority date becomes current for I-140 (Renew NT through mail to avoid wrongful deny from low level staff)
6. I-485 + EAD (Employment Authorization Document) + AP (Advance Parole)
7. Green Card
The key difference are: NT supposes could not have intent to stay permanently, but H-1B is dual intent visa/stutas. If you go Way A, you won't be able to renew your NT. The consequence is you might get some trouble to travel back to US during I-485 + EAD period, if you have ever left US. If you go Way B, you won't be able to leave US during H-1B application period.
Where you born is only related to the priority date for I-140. I could not see why Chinese would have to go through Way B. If anyone knows, please let us all know. Many thanks.更多精彩文章及讨论,请光临枫下论坛 rolia.net
