TN renew question. Hi, I have a question regarding my TN renewal.

本文发表在 rolia.net 枫下论坛My TN will expire at the end of this month. The company lawyer has submitted the TN extension long before ( I guess a couple of months ago ). Today, I asked the TN status and here is what they replied:

"Please be reminded that Mr. xxx can continue working for XXXXX after his current TN status expires on October 2006 even the case is still pending at that point because the extension was filed before his current status expires.
I checked the current status of this filing with the USCIS. It is still pending there. As of September 19, 2006 the USCIS was processing the same type of petitions received around April 7, 2006.

So, it may take about 2 to 3 months for the USCIS to adjudicate his case."

Here is my question:

1.) after successful TN extension, do I get a new I-94 card?

2.) Can I leave US and re-enter again after my current TN expire and before USCIS has adjudicated my case? My understanding is, TN can be obtained at POE. As long as I have the offer, I can get another one in POE even if my current application for TN extension is pending. I do not have such experience, please share your experience.

      • Thank you for the reply. Your answer is right. Here are more information I got. Hope it will be useful for other TN workers. -octane99(octane99); 2006-10-3 {904} (#3243700@0)
        1. When your I-129 is approved, you will get an attached I-94 with
        the same number as your current i-94, with an expiry date one year
        later than your current expiry date.

        As was indicated, you remain in valid TN status PENDING the decision
        by USCIS, for upto 240 days after expiry -- as long as you stay in US.

        2. To re-enter the US after your original TN expires, you would
        either need to wait for approval (and then either have the approval
        sent to you or ask the border officer to look up you approval in the
        sytstem), the officer would then issue you a new i-94 with
        (typically) one year added to your status.
        OR, more simply,
        make a new TN application at the border. Thi new application would
        result in a new I-94 with a 12 month expiry from the date of entry.
        You would then submit a request to cancel your I-129 request, to
        avoid the situation where your I-129 would be rejected.
