我朋友租的Condo业主也是一家公司....说是空置期间若他们不继续付租金,会找追债公司的。 但不知业主要在房子腾空后才登租房广告是否合理?还有就是房客以人口增加房子不够住为由提前终止合同是否有理

说是空置期间若他们不继续付租金,会找追债公司的。

A: This 业主 is kind enough if they just ask 追债公司 to get the money. if 业主 send u to the court, u will pay the rental u own + the legal fee (application fee)$150.

但不知业主要在房子腾空后才登租房广告是否合理?
A: The law does not enforce any one to post an adv for the rental unit.

还有就是房客以人口增加房子不够住为由提前终止合同是否有理
A: No. as long as u move out for your own reason, u get to pay. the only reason would be accept is you life is under dangeous due the unsafe issue from this unit and u have to have hard evidence to prove it.

In this case, your friend will be a loser in the court. that's for sure unless he pays what he should pay.

    我有一个朋友正在租房,但由于父母要过来探亲(约一年),现租的房子不够住了,于是他决定买房,同时提早两个月通知房东需要提前终止租房合同。但房东说我的朋友需要继续负担房租直到房子租出去,而且房东会在他们搬空后才登租房广告,也就是说我的朋友很可能因此至少白给一个月的房租。请问这种情况有没有什么法律文件是保护租客利益的?

      • 他也会找,但不一定能找到。关键房东说要等他们搬空了才会登广告租房,之前空置损失全会算在我朋友头上。

      • By law, the landlord is right. I went through the same matter.

          • any rental unit.
          • any rental unit.
            • if you idn't sign any agreement,usually notice the landlord before 1-2 months for house is enough,
              • if both u & the landlord no dispute, that's ok. if there is any disagreement, everything will follow the law even there is no signed agreement between u & the land lord. Tendent will be the loser in your case.

          • No. if the apt is not a legal unit, u can complain to the gov't, but if u beak the agreement with the landlord, u will be order to pay the rent by the court. they are different case.
            • 一切都合法的话,还得看合约是怎么写的,不管如何,就算打官司也未必就输。
